Terms of Service
These Terms govern your use of probatebrief.com and the ProbateBrief data subscription (the "Service"), operated by Chesapeake Commerce LLC, a Maryland limited liability company, 9 Ramsdell Ct, Gaithersburg, MD 20878 ("we", "us"). By using the Service or requesting a sample you agree to these Terms.
1. What the Service is
ProbateBrief is a weekly spreadsheet of new probate case filings in Harris County, Texas, matched to public property records from the Harris Central Appraisal District. We are not affiliated with, endorsed by, or acting for Harris County, the Harris County Clerk, HCAD, any court, or the State of Texas. We do not give legal, tax or real-estate advice.
2. Data provided as-is from public records
All data is compiled from public records and provided "as is" and "as available". Court and appraisal records can contain errors, change after we collect them, or be incomplete, and property matches are automated estimates with a confidence score, not confirmations of ownership, heirship or authority to sell. Verify anything important with the official source before relying on it.
3. Not a consumer report: prohibited uses
ProbateBrief is not a consumer reporting agency, and the Service is not a "consumer report" as defined by the Fair Credit Reporting Act (FCRA, 15 U.S.C. § 1681 et seq.). You may not use the Service, in whole or in part, as a factor in determining anyone's eligibility for credit, employment, insurance, or housing/tenant screening, or for any other purpose covered by the FCRA.
4. Your responsibilities when contacting people
You are solely responsible for how you use the data and for complying with all laws that apply to you, including the Telephone Consumer Protection Act (TCPA), the National Do-Not-Call Registry and Telemarketing Sales Rule, CAN-SPAM, Texas telemarketing and solicitation laws, and real-estate licensing rules. Be respectful of grieving families. You may not use the Service to harass, threaten, deceive or defraud anyone.
5. License and acceptable use
Subscribers get a non-exclusive, non-transferable license to use each weekly file for their own real-estate business. You may share it within your own company but may not resell, republish or redistribute the files or our compilation.
6. Subscriptions, billing and cancellation
Plans are monthly and billed in advance once you set up billing through our payment processor, Stripe. Founding Member pricing ($99/month, limited to the first 10 subscribers) stays fixed for as long as that subscription stays active; Standard is $129/month. Prices exclude any applicable taxes. You can cancel anytime; cancellation takes effect at the end of the current paid month and we do not refund partial months. We may change Standard prices with notice, effective from your next billing period.
7. Disclaimers
THE SERVICE AND ALL DATA ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, COMPLETENESS, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TO THE FULLEST EXTENT PERMITTED BY LAW.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOST PROFITS. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 3 MONTHS BEFORE THE CLAIM OR US $100.
9. Indemnity
You agree to indemnify us against third-party claims arising from your use of the data, including any contact you make with people listed in it, or your breach of these Terms.
10. Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. Please contact us first so we can try to resolve any dispute informally within 30 days; otherwise disputes will be brought in the state or federal courts located in Texas.
11. Changes and termination
We may update these Terms by posting a new version with a new effective date. We may suspend or end access for breach of these Terms, including any prohibited use under section 3 or 4.
